I've Been in a Car Accident - What Do I Do?

If you are involved in a car accident you should call the police (and EMS if you or someone else is injured) to document what happened. A police officer can create a detailed report that can be powerful evidence of fault later on. If necessary he can be give his deposition or be called to trial to testify to what happened.


It is natural to want to speak to the other driver or drivers involved and to check and see if they are injured. This is fine, however be careful not to discuss the details of the collision or admit fault. Many people feel bad under the stress of the situation and will apologize or admit to causing the collision even if it is not their fault.


If you can do so safely, take photographs at the scene to preserve as evidence. If there are witnesses to the collision who stop to render aid, be sure to get their contact information in case they need to be called later on to give witness accounts.


It is important to seek medical care immediately following a collision. Even if you think you are ok, you could be injured and not realize it due to your body’s adrenaline response. It is important to seek medical care for your health, and to document your injuries for later use as evidence.


Do not share photos of your collision of details of your injuries on social media accounts. Insurance companies will find your posts and can use them later on to try to diminish your claims of injury or impairment. If you have been involved in a collision, it is best to limit your social media posts altogether. A seemingly innocent photograph can be used to argue you are not injured or impaired to the extent you are claiming.
